The Civil Service language used in the document below seems stilted to readers today, but it is worth persevering with as there are nuggets of interesting information in the byelaws. Remember, too, that the civil servants were trying to cover all eventualities which explains why the document below appears long-winded.

RANGE, LLANDUDNO


In the County of Caernarvonshire



BYE-LAWS


Made by  Regulations, 1939, and by His Majesty's Principal Secretary of State for the War Department, under the provisions of the Mililary Lands Act, 1892 to 1903, as amended by Regulation 52 of the Defence Regulations, 1939, and by virtue of that Regulation, for regulating the use of the above-named Range.



I. This range may be used for practice with all types of Artillery weapons, anti-tank guns, anti-tank rifles, machine guns, mortars, grenades, rifles and revolvers.

GENERAL PROHIBITION.


2.        During such time as Notice is given by the hoisting and display of signals, in manner hereinafter provided in Bye-law No. 5, that firing is taking place on the Llandudno Artillery Practice Range, all intrusion on the land area and the foreshore and sea abutting thereon (hereinafter called the sea areas). within the limits set out in the Schedule hereto, and all obstruction of the use thereof, is prohibited.

LAND AND SEA AREAS AFFECTED.


3.        The land area and sea areas affected by these Bye-laws are described in the Schedule hereto.

The sea area is divided into two portions, hereinafter described and referred to as sea area No. I and sea area No. 2 respectively.

OFFENCES DURING FIRING.


4.        While notice that firing is taking place over the areas mentioned in Bye-laws Nos. 2 and 3 is given by the hoisting of signals as provided in Bye-law No. 5, then :—

(i)      No person shall enter or remain within the land area or the sea area affected, nor bring, take or suffer to remain therein, any vehicle, animal, vessel, aircraft or thing, except as provided in Bye-law No. 9.

(ii)    No vessel shall be employed in fishing in the sea area.

(iii)   No pleasure boat shall cruise in the sea area.

(iv)   No vessel shall anchor or remain anchored in or ground on the sea area except under the orders of the Naval Authorities. (v) No aircraft shall alight on or remain in or travel upon the sea area:

(vi) In the event of any vessel or aircraft being from any cause within the sea area, the Master or Pilot, or other person in charge thereof, shall use his utmost endeavours to pass out of the sea area without loss of time.


SIGNALS.


5.        Notice that firing is taking place is given by the hoisting and display of the following signals

(1)   In respect of the whole Land Area and Sea Area No. I.

(a)   By Day—By a Red Flag on a flagstaff at each of the following places:-

(i)      Great Ormes Head Lighthouse.

(ii)    The Firing Point.

(iii)   West Shore Bathing Pool, Deganwy.

(iv)   Beaumaris Pier.

(v)    Penmon Coastguard Station.


(b)   By Night—By a Red Lamp on each of the flagstaffs mentioned in (i) to (v) of (a) above.

(2)   In respect of the whole of the Land Area and Sea Area No. 2.

(a) By Day—By a Red Flag on a flagstaff at each of the following places :—

(i)      Great Ormes Head Lighthouse.

(ii)     The Firing Point.

(iii)   West Shore Bathing Pool, Deganwy.

(iv)    Beaumaris Pier.

(v)     Penmon Coastguard Station.

(vi)    Moelfre Coastguard Look-out.


(b) By Night—By a Red Lamp on each of the flagstaffs mentioned in (i) to (vi) above.

(3)   (a) Notice to aircraft that Mortar firing is taking place will be given by exposing a suitably sited letter " F " (8 ft. by 61 ft.) in black on a white background.

(b) Notice to aircraft that firing is taking place with antiaircraft weapons will be given by exposing a suitably sited letter " A " (8 ft. by 8 ft. 2} ins.) in black on a white background.

DURATION OF SIGNALS.


The Signals referred to in this Bye-law will be hoisted or displayed half an hour before firing commences, and will be lowered, and in the case of letters    " F " and " A " referred to above covered up, as soon as possible after firing has ceased.

RECOVERY OF SHELL, ETC.


6.    No person shall trawl, dredge, touch or search for or otherwise interfere with any shot, shell, bomb, bullet, or other projectile, or any portion thereof found within the land area or the sea area, or take or retain, or be in possession of any such shot, shell, bomb, bullet, or other projectile, or any portion thereof, found within the land area or the sea area.

Any person who when trawling, dredging, or in any manner whatsoever, shall come into possession of any such shot, shell, bomb, bullet, or other projectile, or any portion thereof, within the séå area, shall not retain it, but shall immediately return it in its then condition, and without tampering with it, into the water.

Provided nevertheless that the provisions of this Bye-law shall not apply in cases of persons who recover projectiles under written instructions from the Naval, Military or Royal Air Force Authorities.

OFFICERS AUTHORISED.


7.    Any person doing anything prohibited by or otherwise contravening Bye-laws Nos. 2, 4 or 6 shall be deemed to commit an offence against the Bye-laws so contravened.

The persons hereby authorised to remove or to take into custody without warrant any person contravening Bye-laws Nos. 2,• 4 or 6 or to remove any vehicle, animal, vessel or thing found on the land area or the sea area in contravention of any of the said Bye-laws are :—

     (i) The Offcer i/c of the Range.

(ii)  Any Offcer, Warrant Offcer, Non-commissioned Officer or any Military Policeman for the time being under the Command of the said offcer-in-charge.

(iii) Any person authorised in writing under the hand of the said officer-in-charge ; or

(iv) Any constable.

WHEN VESSEL OR AIRCRAFT IN DANGER.


8.  (1) While any vessel or aircraft is within the sea area, all firing will cease and a second Red flag by day or Red lainp by night will be hoisted below the first Red flag or first Red lamp on the flagstaff at the Firing Point referred to in Bye-law No. 5 (1) (a) (ii) referred to above.

    (2)  (a) When any aircraft is observed on a course likely to bring it flying over the danger area of the Range at a height estimated to be less than 3,000 feet when Mortar firing is in progress, firing will immediately cease and will not be resumed until the airÖraft is out of danger.

          (b) When any aircraft is observed on a course likely to bring it flying over the danger area of the Range at a height estimated to be less than 10,000 feet when Anti-Aircraft firing is in progress, firing will immediately cease and will not be resumed until the aircraft is out of danger.


EXEMPTIONS.


9. These Bye-laws shall not apply to :—

(a)   Any vessel entering or passing through the sea area in the ordinary course of navigation.

(b)   Any vessel compelled to enter or unable to quit the sea area by reason of the exigencies of navigation.


(c)   Any Pilot Cutter carrying out her pilotage duties or at anchor on her station-.

(d)   Any vessel employed in tending, placing or replacing any channel mark buoys or other aids to navigation within the sea area.

(e)   Any vessel engaged in depositing dredged materials or proceeding in connection with such deposits to or from an area utilised for the deposit of dredged materials.

(f)    Any vessel belonging to the Corporation of Trinity House, London, whilst employed on any Trinity House duty or service.

(g)   H.M.'s Ships of War, H.M.'s Aircraft, or any vessel or aircraft employed under Admiralty or Air Council Authority.

(h)   Any aircraft compelled to alight on or unable to quit the sea area.

(i)    Any foreign vessel when outside territorial waters.

(j)    Any vessel anchoring in the sea area under the orders of the Naval Authorities.

INTERPRETATION.


10.  (a)  "Vessel " in these Bye-laws includes ship, yacht, lighter, boat, and craft of every kind, and whether navigated by steam, motor, sail, oars or otherwise.

           (b)  "Aircraft" in these Bye-laws includes all balloons, whether fixed or free, kites, airships, aeroplanes, seaplanes, flying boats, gliders, and other flying machines.

DATE OF OPERATION OF BYE-LAWS.


11. These Bye-laws shall come into force at the date hereof.

SCHEDULE.


Limits of the Land and Sea Areas in respect of Firing Practices from Artillery Practice Range, Llandudno.


DESCRIPTION OF LAND AREA.


The area of the land affected by these Bye-laws is situated at Llandudno, and is bounded as follows :—

On the North.—By a line commencing at a point on High Water Mark at Hornby Cave and extended to the Marine Drive.
On the East.—By a line, the Marine Drive.

    On the South.—By a line commencing at the High Water Mark 200 yards west of Gogarth Abbey ruins and running North East to the Marine Drive.

    On the West.—The High Water Mark at Hornby Cave to a point 200 yards west of Gogarth Abbey ruins.

DESCRIPTION OF THE SEA AREA.    


The sea area is bounded as follows

 

On the South.—By a line commencing at High Water Mark near Gogårth Abbey ruins latitude 530 19' 46" N., longitude 30 51' 40" W., and drawn in a direction of 217 0 true for a distance Of•about 4} nautical or sea miles to a point near the coast east of Penmaen Mawr Point, latitude 530 16' 10" N., longitude 30 56' 18" W., and thence drawn in a direction of 3130 true for a distance of about 3} nautical or sea miles to point south east of Puffm Island, latitude 530 18' 38" N., longitude 40 0' 38" W., and thence drawn in a north-north-easterly direction of 160 true for a distance of about of a nautical or sea mile to a point east of Puffin Island, latitude 530 19' 27" N., longitude 40 0' 17" W., and thence drawn in a westerly direction•of 2670 true for a distance of 7 nautical or sea miles to a point Castle Point or Carreg Dwrban, latitude 530 19' 4" N., longitude 40 12' O" W.

    On the West.—By a line commencing at the last-mentioned point and drawn in a north-easterly direction of 280 true for a distance of 71 nautical or sea miles to a point latitude 530 25' 22" N., longitude 40 6' 27" w.

    On the North.—By a line commencing at the last-mentioned point and drawn in a south-easterly direction of 119 0 true for a distance of about nautical or sea miles to a point on the High Water Mark at the Great Ormes Head Lighthouse, latitude 530 20' 36" N., longitude 30 52' 0" w.

    On the East.—By the line of High Water Mark from the låstmentioned point in a general southerly direction until the starting point is reåched, latitude 530 19' 46" N., longitude 3 0 51' 40" W.

The above described sea area is divided into two areas referred to as Area No. I and Area No. 2 ; the boundaries of these areas are as follows :—

AREA NO 1


     On the South.—By a line commencing at a point on the High Water Mark near Gogarth Abbey ruins, latitude 530 19' 46" N., longitude 30 51' 40" W., drawn in a direction of 2170 true for a distance of about nautical or sea miles to a point near the coast east of Penmaen Mawr

Point, latitude 530 16' 10" N., longitude 30 56' 18" W % and thence drawn in a direction of 3130 true for a distance of about 3} nautical or sea miles to a point south-east of Puffn Island, latitude 530 18' 38" N., longitude 40 0' 38" w.

    On the West.—By a line commencing at the last-mentioned point and drawn in a direction of 160 true for a distance of about 3 nautical or sea miles to a point latitude 530 21' 36" N.,longitude 30 59' 15" W.

    On the North.—By a line commencing at the last-mentioned point and drawn in a direction of 1030 True for a distance of about 4b nautical

or sea miles to a point on the High Water Mark at the Great Ormes Head Lighthouse, latitude 530 20' 36" N. , longitude 30 52' O" W.

    On the East.—By a line of High Water Mark from the last-mentioned point in a general southerly direction until the starting point is reached, latitude 530 19' 46" N., longitude 30 51' 40" W.



AREA No. 2.


    On the South.—By a line commencing at a point on the High Water Mark near Gogarth Abbey ruins, latitude 530 19' 46" N., longitude 30 51' 40" W., and thence drawn in a direction of 2670 true for a distance of 12å nautical or sea miles to a point near Castle Point or Carreg Dwrban, latitude 530 19' 4" N. , longitude 40 12' 0" W.

    On the West.—By a line commencing at the last-mentioned point and drawn in a north-easterly direction of 280 true for a distance of 71 nautical or sea miles to a point latitude 530 25' 22" N., longitude 40 6' 27" w.

    On the North.—By a line commencing at the last-mentioned point and drawn in a south-easterly direction of 1190 true for a distance of about 9k nautical or sea miles to a point on the High Water Mark at the Great Ormes Head Lighthouse, latitude 530 20' 36" N., longitude 30 52' 0" w.

On the East.—By the line of High Water Mark from the lastmentioned point in a general southerly direction until the starling point is reached, latitude 530 191 46" N., longitude 30 51' 40" W.

NOTICES.


PENALTY FOR OFFENCES.

(1) By Section 17 (2) of the Military Lands Act, 1892, it is provided :—

If any person commits an offence against any Bye-law under this Act he shall be liable, on conviction before a Court of Summary Jurisdiction, to a fine not exceeding FIVE POUNDS, and may be removed by any constable or Officer authorised in manner provided by the Bye-law from the area, whether land or water, to which the ByeLaw applies and taken into custody without warrant and brought before a Court of Summary Jurisdiction to be dealt with according to law, and any vehicle, animal, vessel or thing found in the area, in contravention of any Bye-law, may be removed by any constable or such officer as aforesaid, and, on due proof of such contravention, be declared by a Court of Summary Jurisdiction to be forfeited to His Majesty.


APPLICATION TO SEA AREA.


(2)   By Section 2 (2) of the Military Lands Act, 1900, it is provided:-


Where any land, the use of which can be regulated by Byelaws under the Mililtary Lands Act 1892, or this Act, abuts on any sea or tidal water, or where Rifle or Artillery practise is or can be carried on over any sea, tidal water, or shore, from any such land, Byelaws may be made in relation to any such sea, tidal water, or shore as if the were part of the land.



PROGRAMME OF FIRING AND PUBLIC NOTICES.


(3) Firing may take place at any time of the day or night. The programme of firing from the Range may vary annually according to military requirements.

Public notification that firing will take place will be made as follows:-

PROCEDURE FOR CLEARING SEA AREA.


(4).   (a) Vessels entering or remaining within the sea area in contravention of any of the preceding Bye-laws may, under Section 17 (2) of the Military Lands Act, 1892 (see (I) above), be removed from the Area. In such cases any vessel acting under the orders of the local Military Authorities will, when necessary, tow the offending vessel out of the area.

        (b) Masters of vessels entering or remaining within the Sea Area by reason of the exigencies of navigation and exempt from the operation of the Bye-laws under Bye-law No. 9 (b) are requested to assist the carrying out of firing practice by consenting to be towed out of the area, if necessary, by any vessel acting under the orders of the local Naval, Military or Royal Air Force Authorities.

RED FLAG ON TARGET-TOWING VESSEL.


(5)      A Red Flag on the Range Towing vessel is a signal that the Target is ready to be or is being fired at, and Masters of vessels seeing the Red Flag hoisted should, if possible, keep clear of the Range.

WHERE BYE-LAWS CAN BE OBTAINED.


(6)      Copies of these Bye-laws can be obtained at the Office of the Commandant, Coast Artillery School, Llandudno.

WHERE PLAN OF RANGE CAN BE INSPECTED.


(7)      A plan and Admiralty chart showing the danger areas affected by these Bye-laws can be inspected at the above Office.

AIRCRAFT WARNING.


(8)      Aircraft are warned not to fly in the vicinity of this Range while firing is in progress and no liability for accidents to aircraft arising from the use of the Range can be admitted.
